As H-1B cap-selected candidates move forward with their petitions, many are surprised to learn that their educational credentials and professional experience do not automatically translate into a higher wage level under the H-1B system.

"Since I have a Ph.D. and years of experience, my H-1B wage level must be Level 3 or 4."
Not true.
In the H-1B system, wage levels are determined by the requirements of the job offered, not the qualifications of the person being hired. A candidate may be highly overqualified for the role, but that does not obligate the employer to pay a higher wage level—if the role itself is legitimately entry-level.
