🌟 What is N-648?

The N-648 is a "medical waiver form," allowing applicants who are unable to pass the English and civics tests due to physical developmental disabilities or mental impairments, to be exempted from the naturalization test requirement. 

 

🔍 Legal Definition and Applicable Conditions of N-648 Waiver

⚠️ Note: "Health Problems" are not enough to be exempted! The client must strictly follow the requirements below:

1️⃣ Medically Documented Issue: Anatomy, physiological, or psychological abnormalities leading to long term/permanent function impairment;

2️⃣ Unable to study or present knowledge: You must prove that the applicant (Even with translation or special education aids) is unable to master English and the citizenship test content

 

👩Who must sign the form?

‼️ American U.S license physician, osteopath, or clinal psychologist. Other petitioner's are not accepted, so be sure to confirm qualification in advance.

 

💡Our successful cases:

1️⃣ Exemption for autistic patients: applicants with 10 below 1% an no English proficiency can obtain citizenship without taking the N-648 Test

2️⃣ Exemption for the elderly: those who have lost their learning and memory abilities due to brain degeneration can obtain citizenship without taking the test

3️⃣ Exemption for stroke patients: those who can only breathe independently and move their fingers slightly, can be exempted from the test requirement after passing the H test.

⚠️ Common Misunderstandings: 

❌ “Old age/Poor English”≠ automatic exemption! USCIS will investigate the relationship between medical documents and functional impairment. (Simply "poor English" or "no time to study" does not qualify)

❌ “Short term sickness" Does not qualify! The abnormality or medical impairment must last at least 12 months or be a lifetime sickness (8 CFR § 312.2(b)(2)).

❌ Non-licensed physical signature = direct rejection! Only US licensed MD/DO/clinical psychologists (explicitly required by the Immigration Bureau).

⚠️ 律师划重点:常见误区

❌ “年龄大/英语差”≠自动豁免!移民局会审查医学证据与功能障碍的因果关系。 (单纯“英语不好”“没时间学习”不符合资格)

❌ “短期疾病”不适用!损伤需持续至少12个月或永久性(8 CFR § 312.2(b)(2))。

❌ 非指定医师签署=直接拒批!仅美国执照的MD/DO/临床心理学家(移民局明确要求)。
