General Process
Qualifications: Individuals who can demonstrate extraordinary ability in sciences, arts, education, business, or athletics through sustained national or international acclaim
Eligibility: Sustained national or international acclaim, continue to work in your field of expertise in the U.S., your entry will benefit the U.S.
Petition: Self Petition
1. Filing the I-140 Petition – Filing the I-140 (Immigrant Petition for Alien Worker) & Supporting documents of 3 out of 10 criteria or one-time major achievement (Pulitzer, Oscar, Olympic medal) + additional documents.
2. USCIS Processing – Once filed, the petition is reviewed and approved by USCIS.
3. Consular Processing or Adjustment of Status –
- If applicant is outside the US: After I-140 Approval, Consular Processing will occur (Applying at US embassy / consulate)
- If applicant is already in the US: File form I-485 and final interview to adjust their status to permanent resident
